Legal Challenge in a Blog Comment?
I was enjoying this post from Michael McLaughlin on testimonials, and preparing to add a comment, when as I scrolled down the page, I noticed that the first comment was not so much a comment, but a 'don't infringe on our trademark by using it in the form of a phrase' legal letter in the form of a blog comment. I'm not an attorney, so I have no idea if this is really a legit issue (using the phrase used that also happens to be the name of a magazine) but I can tell you that this tactic, sending "Cease & Desist Comments" whenever your name is mentioned, is not a great way to spread the good word about your brand through the blogosphere. I used to subscribe to the magazine in question, and I can tell you from the back issues perspective that it was a flaming piece of shit back then, and if their 1979 mentality in this comment is any indication, it's still a purple turd today. Assholes. Alright, now I have to go back and comment on Michael's post, The Trouble with Testimonials. Post a comment
